Over 70 percent of the visitors are from within the state. New Yorkers are trekking upstate for vacation. Moreover, it appears roughly one in four of them are doing so to check out del Lago. The new casino opened in February. It is one of four new casino resorts opening in the state as part of a New York casino expansion measure. The del Lago joins Tioga Downs and Rivers Casino Resort in Schenectady. The fourth property, Montreign Casino, is set to open in the Catskills later this year. When Chamber of Commerce representative Rick Newman presented the survey findings to the county’s Board of Supervisors, he pointed out the area is one of only six counties in the state which have seen visitor spending grow every year since 2012. Considering the casino is owned by Rush Street Gaming, the likely culprit to host the series is the company’s televised poker wing, Poker Night In America. What’s working at Rivers Casino? Lots of things are going great at Rivers Casino, but the most important one is revenue. In its first month of operation, the site took in $10.8 million. Early projections put the casino on pace to meet its earnings goals for 2017. “We have a very loyal crowd, already, of people that are here constantly,” said Danny Brockdorf, the casino’s vice president of marketing. “But we’re thinking about ways we could potentially accommodate more people.” Poker, especially, is drawing a loyal group of followers, including some notable pros local to the area, like Shaun Deeb. The Senate approved the budget this week, and the next step is for the state Assembly to include it in its budget proposal. The state legislature has until March 31st to agree on a finalized budget. Support of Gary Pretlow sets online poker efforts apart from 2016 This is not the first time the budget includes online poker regulation in New York. Last year, the Senate included online poker in the budget as well. The Senate also passed an online poker bill with ease in 2016 only for it to be held up in the Assembly. What sets 2017 apart from last year is the support of Assemblymember Gary Pretlow. He was a major roadblock for online gambling in 2016, but has since changed his tune on the subject. In a recent interview, Pretlow walked back some of his comments and concerns about online poker. He met with New Jersey online casino regulators to learn more about how the state keeps sites safe and came away with a new appreciation for iGaming. Pretlow is actually the sponsor of the Assembly’s online poker bill, A5250. The bill is essentially a carbon copy of the Senate measure introduced by Sen. Jon Bonacic, S3898. Governor and Assembly budgets do not include New York online poker There may be more momentum for online poker in New York, but there are still several obstacles in its way. So far the Senate is the only group to include numbers from online poker in its budget. Governor Andrew Cuomo’s proposed budget has no such language, nor does the Assembly’s. With two weeks to finalize next year’s budget, there may not be enough time to reach an agreement on online poker. It could provide a healthy boost to New York coffers if passed though. The bills stipulate an upfront licensing fee of $10 million for each online poker site. Pretlow’s support in the Assembly will be huge in possibly getting iPoker numbers in the Assembly’s final budget. Gov. Cuomo could be more difficult to persuade. Cuomo’s office is sheepish on bringing online poker to the Empire State. Cuomo does not want to do anything to jeopardize the economic welfare of the new casinos which recently opened upstate as part of a 2013 gambling expansion measure he signed. So far those casinos are faring well. It is too early to say with certainty, but projections suggest the properties are on pace to meet earnings expectations. Cuomo’s office did not say it outright opposes online poker. A spokesperson did say any further expansion, online or otherwise, would need to considered carefully. Online poker in New York should help, not hurt existing casinos Cuomo’s office is one of several political groups to express unfounded concern online gambling cannibalizes existing casinos. Similar concerns came up in a recent Pennsylvania online casino hearing, but the evidence does not back up the assumptions. Testimony from existing online casino operators, Caesars Entertainment and Golden Nugget, both emphasized online gambling expansion brought new customer to brick and mortar properties and reinvigorated some lapsed customers. With two other casinos now up and running, New York is seeing the gaming tax dollars flow. By the end of February, New York had collected a total of $13,626,888 in gaming taxes. Full year figures will be boosted by a fourth casino in NY Early revenue numbers aren’t much help in forecasting full-year figures, but it is already clear that the casinos are going to make a major contribution to New York’s budget. Total tax paid for the three casinos in February alone came to a little over $10 million, suggesting that annual tax receipts for the existing casinos will be above $120 million. A fourth casino will further boost revenues when the Montreign opens in Sullivan. The Montreign is owned by Empire Resorts, and is the final casino to have received a license from the Gaming Commission. Each applicant was also required to pay a $50 million fee for the license, giving an immediate one off boost to state revenues. The Gaming Commission is limited to issuing only four licenses by the 2013 Upstate New York Gaming Economic Development Act, so the Montreign will be the last casino to be authorized under the current law. Forecasts against revenue realities In its application to the Gaming Commission, each casino was required to forecast its revenue expectations and expected gaming tax payments.
Montreign forecast “gaming revenues and gaming tax revenues in 2019 of $301.6 million and $103.4 million, respectively.”
Tioga Downs estimated gross gaming revenues and gaming tax revenues in 2019 of $98 million and $31.2 million.
Rivers projected tax revenues to the state “to be in the range of $69-86 million in year one and $81-100 million in year five.” Rivers did not estimate revenues, but from the tax estimates they can be deduced to be in the range of $230 million-$287 million for year one.
Lago projected gross gaming revenues and gaming tax revenues in 2019 of $282 million and $80 million. Forecast year one tax revenues from three casinos in operation add up to a minimum of $180.2 million—a monthly rate of $15 million. The actual $10 million for February is well short, but the evidence so far suggests that the forecast figures are within reach. Tioga Downs has filed three months of financial figures with tax payments of:

February — $1,948,189 At that growth rate it will reach its forecast tax payment rate of $2.6 million per month by the end of the second quarter this year. If the other casinos match this performance, then New York will receive the benefits it expected when Governor Andrew Cuomo signed the new law into effect. State regulated online poker could provide another revenue source 2016 saw New York get serious about the possibility of legalizing online poker. A bill submitted by Senator John Bonacic passed a Senate vote by 53 votes to five. At the Senate Committee on Racing, Gaming and Wagering hearing in September 2015, the base case scenario was presented: At the currently proposed tax rate of 15 percent, that level of revenue would produce an extra $24.6 million in tax revenues at market maturity.

Andrew Cuomo has not expressly condemned online gambling expansion, but a recent comment to a local reporter indicates he may proceed cautiously on a the issue. Cuomo concerned about local brick and mortars FiOS1 reporter Andrew Whitman broke the story on Twitter with a quote from the Governor’s office on how he felt about the iPoker issue. The response came not directly from the Governor, but from his Press Secretary Dani Lever: Three of four new casinos just opened upstate. They are the byproduct of a gambling expansion law Cuomo signed into effect in 2013. The addition of the four new properties expands the total number of casinos and racetracks with gambling components in New York to 19. Some concern over land-based casino expansion The new casinos are literally weeks removed from opening and questions are already circling about whether or not the area is too saturated for all of the properties to succeed. “I think it’s individual with each of them,” James Featherstonaugh, the president of the New York Gaming Association, told the Rochester Deomcrat and Chronicle. “They are convenience casinos, if you will. So it is very much sensitive to the local market.” Assemblymember and chairman of the Racing and Wagering Committee J. Gary Pretlow was much more optimistic about the new properties in the same article. “They will all work. The people who spent a lot of money putting these together know what they are doing,” he argued. Pretlow did go on to concede there is some risk expansion will hurt the existing marketplace, especially in Ontario County. “I do think that area of the state is a little bit saturated, and it’s going to hurt the racetrack at Finger Lakes. And the racing industry depends on Finger Lakes.” Online gambling could help, not hurt What Cuomo may not realize is that iGaming would not introduce new competitors to the marketplace. Rather, online gaming creates another revenue source for existing brick and mortar casinos and racetracks. Pretlow was once a critic of online gaming, but walked back his statements once he visited with regulators in New Jersey to see how the system works. The Garden State is a great case study of the positive impact regulated online gambling can have on a land-based casino industry, as online poker and online casinos have helped turn around the struggling Atlantic City economy. In January of this year the state had a big month boosted by record numbers for iGaming. Overall casino revenue exceeded $200 million, $19 million of which was earned online. Whitman clarified in subsequent tweets that Cuomo may not have fully vetted the issue at this point. The initial statement from his office was in direct response to Whitman bringing up the subject. Cuomo’s stance on gaming mixed Since Cuomo took office in 2011, he has been relatively supportive of gambling issues, but rarely is the voice at the forefront of gaming expansion. Last year he signed a bill authorizing daily fantasy sports. He also authorized corporate casino expansion. More recently Cuomo vetoed a law which would allow online lotteries to help support local charities. With online gaming being seriously discussed in the state, now is the time to take action. NY Online Poker Optimism Grows As Crucial Lawmaker Pretlow Signals Intention To ‘Get It Done’

2 Currently identical NY online poker bills in Senate and Assembly Recent developments in New York state seem to indicate there is a very real possibility the state will legalize online poker this year. Previously New York has been a state on the fringes of iPoker, often considering it, but never really making much headway. Now, the support of Assemblymember J. Gary Pretlow has the issue moving forward full steam ahead. Pretlow gives lengthy interview vocalizing his support Pretlow has previously been a critic of online poker. He has categorized it as a skill game, and expressed concern over problem and underage gambling. Pretlow gave an interview with local New York station FiOS1 last week and walked back much of his criticism. He met with regulators in the state of New Jersey, where online poker is legal, and saw how technology geolocates, age verifies, and ensures fairness on online poker sites. After being satisfied with what he saw, Pretlow is now actively campaigning to bring online poker to the state. Interviewer Andrew Whitman asked Pretlow if he changed his mind about poker’s classification as a game of skill vs. a game of chance. “What I have to say to get it done is what we say to get it done,” Pretlow replied. It does appear Pretlow intends to get this done. He is the chairman of the Racing and Wagering Committee and a key person to offer support to the online poker measure. Currently identical NY online poker bills in Senate and Assembly Pretlow sponsored a bill in the Assembly that is an exact word-for-word copy of a bill introduced in the state Senate. Last June, a version of the bill passed in the Senate by an overwhelming majority, but failed to go anywhere in the Assembly. The Senate finance committee already unanimously approved the bill, which is the first hurdle in getting the bill passed into law. The next obstacles should be easier than in the past, at least according to Pretlow: The bill(s) would allow up to 11 licensed online poker providers. Each provider would pay a $10 million licensing fee. The operations would be taxed at a rate of 15 percent. The bill also leaves open room to form interstate compacts with other states offering online poker, like neighboring New Jersey. Interstate compacts would allow states to share liquidity, increasing the player pool.
